General Terms and Conditions of Sale
1. General Information
These general terms and conditions of sale (hereinafter "Terms and Conditions") apply to all sales concluded by KAZU with its customers (hereinafter "the Client"), whether they are professionals or individuals. Placing any order implies unconditional acceptance of these Terms and Conditions.
2. Orders
Every order must be confirmed in writing by KAZU. Orders are firm and final from the date of confirmation by KAZU. KAZU reserves the right to refuse any order for legitimate reasons.
3. Price
Product prices are indicated in euros or US dollars, excluding taxes and shipping fees, unless explicitly stated otherwise. KAZU reserves the right to modify its prices at any time. Products are billed based on the rates in effect at the time of order confirmation.
4. Payment
Payment is made according to the terms agreed upon between KAZU and the Client, either by bank transfer, credit card, or any other payment method accepted by KAZU. Payments must be made by the due date indicated on the invoice. In case of late payment, late fees will be applied in accordance with applicable law.
5. Delivery
Delivery times are provided for informational purposes and do not constitute a firm commitment from KAZU. Under no circumstances shall a delivery delay result in penalties or compensation for damages. The risk of loss or damage to the products is transferred to the Client upon handing over the products to the carrier.
6. Receipt and Conformity
The Client must check the conformity of the delivered products and immediately report any anomalies or damages to the carrier and KAZU. In the absence of any reservations made within 3 days of receiving the products, they will be considered as conforming and accepted by the Client.
7. Withdrawal and Return
In accordance with current legislation, the Client has a period of 7 days to exercise their right of withdrawal, without having to provide any reasons or pay any penalties, except for return shipping costs. Returned products must be in perfect condition, in their original packaging, and accompanied by the invoice.
8. Warranty
The products are covered by the legal warranty of conformity and the legal warranty against hidden defects, allowing the Client to return defective or non-compliant delivered products. Any warranty is excluded in case of misuse, negligence, or lack of maintenance by the Client, as well as in cases of normal wear and tear or force majeure.
9. Liability
KAZU's liability is limited to the amount of the order. KAZU shall not be held liable for any indirect or immaterial damages, such as loss of profit, loss of opportunity, or loss of clientele, resulting from the purchase of its products.
10. Intellectual Property
All texts, comments, works, illustrations, and images reproduced on the KAZU website are reserved under copyright law and intellectual property rights worldwide. Any total or partial reproduction of the KAZU website is strictly prohibited.
11. Data Protection
KAZU is committed to respecting the confidentiality of the personal data provided by the Client and to processing it in compliance with the applicable legal provisions. The Client's personal data is collected and processed solely for the purpose of order management and business relations.
12. Applicable Law and Jurisdiction
These TCS are governed by Malagasy law. Any dispute relating to the interpretation or execution of these TCS shall be subject to the exclusive jurisdiction of the Malagasy courts.
13. Acceptance of the General Terms and Conditions of Sale
Placing an order implies the full and unconditional acceptance of these Terms and Conditions by the Client. No document or special condition shall, unless formally and in writing accepted by KAZU, prevail over these Terms and Conditions.
